Stop using ‘Burger Kung’ title, Bombay HC

The Bombay High Court in an interim order today restrained a Pune-based burger joint to use the name, ‘Burger King’ after US giant Burger King  filed a plea against the usage of its trademark. September 6, is the next date of the hearing.
An eatery, Burger King, in Pune is owned by Anahita Irani and Shapoor Irani. It was sued by the multinational fast-food corporation claiming violation  of trademark laws.
The Pune court in its order had said that the eatery had been using the name since 1992 much before the US company started doing business in India. Hence, it was not in violation of the trademark.
Burger King is the second largest fast food hamburger company in the world and started using the trademark since 1954. There are currently over 1,200 of these restaurants in Asia.
