According to the rules, in order to have an Opposition leader, one party should have 10% of the total strength of the Assembly.

With Maharashtra Assembly’s strength is 288 seats, at least one opposition party must have 28 MLAs for it to have a Leader of the Opposition. In the present 15th Maharashtra Assembly, no party has the required number of members. Congress has 16, NCP has 10, and Shiv Sena has 21 seats, which does not meet the required number of seats.

The BJP-led Mahayuti alliance won 233 out of the 288 seats, leaving no space for the opposition to have its leader in the assembly, first time in 6 decades.
