Municipality reluctant to act against ‘unauthorised construction’

Despite High Court’s strict warnings there’s hardly any change in the functioning of municipality towards unauthorised constructions in the city.

Making 83-year-old run from pillar to post for years together and not taking action by BMC ‘D’ ward against unauthorised structures is the glaring example of municipal inaction.

The High Court has often passed strictures and has come down heavily over the lay back attitude of municipality when it comes to initiating action against the mushrooming of unauthorised structures in the city.

Expressing ‘shock’ over inaction against illegal constructions, the Bombay High Court, on Thursday, directed the Thane Municipal Commissioner to conduct a survey of all illegal structures across its wards including developing areas and green zones and act against them ‘before it is too late.’
The court warned, ‘separate machinery’ would be required to govern TMC if illegalities persist without actions.

The HC has also, time and again, chided the BMC for not taking action against illegal hawkers and unauthorised constructions in the city. However the situation has not changed yet.

Much to the chagrin of a senior citizen, an 83-year-old who left no stone unturned, seeking action against myriads of the violations of the civic norms in his Orion Tower, but failed, as the BMC ‘D’ ward just refused to acknowledge the unauthorised structures, from top to toe, which are clearly seen with the naked eyes. The ‘D’ ward officials are still sitting on the dossiers full of complaints, with facts proofs and evidence, against the irregularities in the Orion Tower, probably the BMC is waiting for another reprimand from the High Court, the door of which will be knocked soon by the harassed senior citizen.

An unauthorised ‘guest house’ in Mazgaon, which serves as a brothel, in a residential area, was given a big rope by the BMC. Despite locals complaining against the guest house for more than 6 months the BMC failed to demolish the structure and give ample opportunities for the operators of the unauthorised guest house to acquire a ‘stay order’ against the demolition.
These are just a couple of examples. The list of dereliction of duty and inaction by the municipality against the unauthorised constructions in the city goes on and on, rendering the common men helpless, instilling in the minds of the public that to elicit action from the municipality is a hard nut to crack.
