July 1, 2025 – Mumbai: Following the Bombay High Court’s strong observations in the Tardeo tower case—where a 34-storey building was found occupied without fire safety clearances or an Occupation Certificate (OC)—similar concerns are now emerging in Mazgaon.
At the Ashiyana Cooperative Housing Society Rehab Building, located at Nariyalwadi, Sant Savta Marg, Mazgaon – 400010, residents have reportedly been shifted into the premises without:
– A valid Fire NOC from the Mumbai Fire Brigade
– 🏢 An Occupation Certificate (OC)
– Demolition clearance for the original transit camp
Despite multiple representations by civic advocate Imtiyaz Khan, the matter remains unresolved. These developments raise serious questions about compliance with SRA norms, DCPR 2034, and fire safety regulations.
In the Willingdon View CHS case, the Bombay HC noted:
“What is further glaring and shocks our conscience is that floors 17 to 34 have no OC… The same is being occupied… There is gross violation and breach of building laws…”
The Court emphasized that residents without OC are exposed to risk, and that legal accountability may follow in the event of any incident.
